Clerk also required the defendants to respond to the Writ of Certiorari (which requires the concurrence of four Justices) by December 1. At that time, Mr. Obama must present to the Court an authentic birth certificate, after which Mr. Berg will respond.

If Obama fails to do that, it is sure to inspire the skepticism of the Justices, who are unaccustomed to being defied. They will have to decide what to do about a president-elect who refuses to prove his natural-born citizenship.


Wow. I had written this whole thing off as a tangent of the "secret Muslim" crap that is popular among the fringiest fringes of the GOP. That the Court is directing Obama to produce and original vaulted copy of the birth certificate should put an end to this rather quickly.

I'll ask again: What happens if he cannot produce said certificate? Are we, God help us, left with Biden as President? Will McCain get in by default? Or, even worse, will we be led by Speaker Pelosi until yet another election is called? That last scenario is too frightening to contemplate. Only that would make me prefer Obama to anyone else. On second thought, Pelosi is so dimwitted she'd probably be unable to get organized enough to really screw us like Barry is planning to.

Have you found anything that makes you think this is actually going to the SCOTUS?

Nope, just the link provided. I suspect if indeed it is true (So what? We can't rely on your reporting -Ed.) we should be hearing more about it rather soon.

I read on another blog the comment of a Washington lawyer which is that the Supreme Court is not a court that judges facts, and it only rules on issues of law.

Thus Berg is probably misleading us by saying that Souter demanded that Obama provide a copy of his birth certificate.

He is right in saying that Obama has until Dec. 1 to respond to the request for a writ of Certiorari, but that is not on the issues of whether he was born in Hawaii but on the issue of whether the lower courts were right to dismiss Berg's suit because Berg did not have standing to sue.

It is most unlikely that the Supreme Court will issue Certiorari, but even if it does it will not look into the issue of the birth certificate itself, but send it back to a lower court to determine the proof of birth in Hawaii. If that were to occur, there is no guarantee that the lower court would rule that the certification of live birth is insufficient to prove that Obama was born in Hawaii. UNLESS there is evidence that Obama was born somewhere else than Hawaii.

In short, there is very little chance of legal action on this.

I think that this is something for people to keep talking about. The GOP needs to regroup, because this will defintely be an easy time to get the money spending elitist illuminati out of office.
