Why Replacing Biden With Hillary Makes Perfect Sense for Obama

"It's time to dump Biden and replace him with Sen. Hillary Clinton. I don't care how it's done. Campaign chief David Axelrod can figure that out. And the sooner the better. Because I'm starting to think that if Team-Obama doesn't do something dramatic fast, it's gonna lose this election."

This from the bastion of neoconservatism, HuffPo. Just last week I was hearing about an Eagleton scenario from some formerly sane people. Seems they were right just right about the wrong party.

I don't believe Barry will dump Biden. It is, indeed, too late. It would be recognized as the craven and desperate move it is. Nor will Barry pick Hillary. He had his chance and she might even say no if asked. If he's that far in the rear she would rather see him tank and then run against him in '12. If she takes the VP job now he's in for at least two runs which puts her ambitions off until '16. No, I think this one is locked up tight for both sides. "Ya run whatcha brung" as they say in racing.

Could he dump Biden at this point without jeopardizing his ability to pick his own Vice-President?

The 12th Amendment provides for the election of President and Vice-President separately. If some states have already finalized their ballots at the time Obama were to dump Biden, some electoral votes would like be given to Biden for Vice-President. Depending on the number of states that were already finalized, Biden could still finish first or second in the electoral college for Vice-President. If there is no majority for the office, the election would be thrown into the Senate where they would have to pick from the top two electoral vote-getters, which may include Obama's replacement for Biden.

Now, some might suggest that Obama electors could cast their vote for Vice-President based off Obama's actual choice, regardless of who their state elected, but that's of dubious legality from what I understand. I've heard (but neither the time nor the inclination to check) that there are laws prohibiting such actions by "faithless electors."
